Many areas of Family and Juvenile law overlap with each other, especially when it relates to the protection of our children. For instance, in Arizona we have a law called “in loco parentis” which permits persons acting as caretakers for a child in place of the parent (including grandparents) to file a custody or visitation action. In Arizona, a guardian can be appointed to make personal, healthcare and living arrangement decisions for a minor. Guardianship is always a court proceeding where only the court can create the actual guardianship.
